AGREEMENT ON THE PROVISION OF INFORMATION AND CONSULTING SERVICES

Company Jobs Hire Sp. z o.o.., registered in accordance with the laws of the Republic of Poland, represented by the Chairman of the Board Mila Kesareva, acting in accordance with the Partnership Agreement,
hereinafter referred to as the “Contractor”, and any individual or legal entity that accepts the terms of this Agreement, hereinafter referred to as the “Client”, jointly – the Parties, enter into this Agreement with the following content:

1. Subject of the Agreement

1.1. The Contractor undertakes to provide the Client with information and consulting services for the purpose of
selection and search for job offers, including conducting initial selection and organizing
communication with potential employers in the Republic of Poland.
1.2. This agreement ensures the Client’s participation in the process of preparing the necessary documents used to coordinate the candidate with the employer and guarantee the Client a high level of quality of the services provided, but does not guarantee employment.

2. Contractor’s obligations
  • 2.1. Search for relevant job offers that meet the Client’s request.
  • 2.2. Initial assessment of the candidate’s compliance with the employer’s requirements.
  • 2.3. Resumes or personal data of candidates will be transferred only with their consent.
  • 2.4. Provision of basic consultations on working conditions and employer’s requirements.
  • 2.5. If necessary, organizing assistance in the preparation and execution of documents, etc.,
    namely:

    • 2.5.1. Professional preparation of a resume in accordance with the requirements of the employer and the country
      of employment.
    • 2.5.2. Professional writing of a cover letter taking into account the specifics of the job offer.
    • 2.5.3. Assistance in preparing cognitive tests (if such a selection stage is available).
    • 2.5.4. High-quality and correct translation of documents into Polish.
    • 2.5.5. Adaptation of documents to the requirements of a specific employer.
    • 2.5.6. Professional preparation of characteristics and recommendations, their translation, preparation and implementation
      certification, if necessary.
    • 2.5.7. Advisory support at all stages of visa preparation, including:
      • 2.5.7.1. Assistance in issuing an invitation from the employer (Declaration or Work Permit).
      • 2.5.7.2. Preparation of an application for obtaining a corresponding invitation.
      • 2.5.7.3. Preparation of a letter of guarantee (if necessary).
      • 2.5.7.4. Assistance in issuing an insurance policy.
      • 2.5.7.5. Assistance in filling out a visa application form.
      • 2.5.7.6. Coordination of the process of submitting documents to the visa center.
3. Client’s obligations
  • 3.1. Provide reliable information about yourself, namely: education, professional experience.
  • 3.2. Notify the Contractor in a timely manner of any changes in intentions or data.
  • 3.3. Follow the Contractor’s instructions necessary to participate in the recruitment process.
  • 3.4. Provide the Contractor with:
    • 3.4.1. A high-quality photo or scan of the cover of a valid international passport.

4. Payments

4.1. The Contractor’s services for the selection of job offers and employment of employees for the Client are free of charge.

4.2. If the Client wishes to use additional services related to the employment process, such as:

  • 4.2.1. Professional preparation of personal documents (including resumes, cover letters, reference characteristics) with subsequent translation into Polish.
  • 4.2.2. Adaptation of documents to the requirements of a potential employer.
  • 4.2.3. Consultative support in preparing for the candidate’s assessment.
  • 4.2.4. Assistance in organizing the process of obtaining a job invitation, including filling out the appropriate forms and coordinating with the employer.
  • 4.2.5. Assistance in preparing a package of documents for submitting a visa application: filling out a questionnaire, preparing a letter of guarantee.
  • 4.2.6. Technical assistance in registering at the visa center, support in communicating with consular institutions.
  • 4.2.7. Providing advice on visa issues, living conditions and other issues related to staying in the Republic of Poland.
  • 4.2.8. Providing assistance in obtaining an insurance policy according to the European model for the purpose of working abroad, namely: correct entry of personal data into the insurance agent’s system, assistance in drawing up the policy in the appropriate format, consulting support at all stages of preparing the insurance document.

4.3. If the Client takes up the job and works for at least 1 month in the position for which the documents were prepared, the Contractor undertakes to return the entire amount paid for the preparation of the documents. This option applies only to the job offer and the employer for whom the documents were prepared.

4.4. If the documents prepared for a specific employer fail to pass the check or are rejected by this employer, the Contractor undertakes to prepare the documents again free of charge or to refund the funds if the rejection was directly related to the quality of the prepared documents.

4.5. If the employer’s decision to transfer the job offer, change the terms of employment or reject the application is not related to the quality of the prepared documents, these factors are not grounds for a refund. The Contractor cannot influence the employer’s decision to transfer the job offer, change the terms or refuse to hire.

4.6. Refunds for the preparation of documents, in accordance with clauses 4.3 and 4.4, are made only on condition that the documents were prepared for the needs of a specific job offer and employer, and if the Client has not changed the job offer or employer after the start of the preparation of the documents.

4.7. Refunds are made within 5 (five) business days from the date the Client submits the refund request, provided that the service was not performed or was performed partially, in accordance with the above paragraphs.

5. Processing of personal data

5.1. The Client consents to the processing and transfer of his/her personal data to employers and partners in the process of preparing documents and employment.

5.2. Data processing is carried out in accordance with the current legislation of the Republic of Poland.

5.3. The Client has the right to withdraw consent at any time, which will lead to the termination of participation in the recruitment process.

6. Term and termination

6.1. This Agreement is a public offer and is considered concluded from the moment the Client pays for the services. Payment for the services by the Client means full and unconditional acceptance of the terms of this offer.

6.2. The Agreement comes into force from the moment the funds are credited to the Contractor’s account and remains valid until the Contractor fully fulfills its obligations under this Agreement, i.e. until the provision of all services ordered by the Client.

6.3. After payment, the Client does not have the right to unilaterally terminate the Agreement or refuse to accept its terms, since the Contractor is obliged to begin providing services immediately after payment.

6.4. The Contractor has the right to terminate the Agreement early only if the Customer is refunded the entire amount paid.

6.5. The text of this Agreement is publicly available on the Contractor’s official website. Before making a payment, the Client is obliged to familiarize himself with the content of this Agreement, which confirms the fact of payment, which is equivalent to accepting the terms and conditions.

7. Final provisions

7.1. Any disputes that may arise in connection with this Agreement shall be resolved through negotiations or, if this is impossible, in court in accordance with the legislation of the Republic of Poland.

  • Your personal data is stored:
    1. Until consent is revoked;
    2. Not more than 3 years from the date of the last set.
7. Your rights
  • You have the right:
    1. Full access to your personal data;
    2. Correction (deletion), deletion or limitation of processing of personal data.
8. Voluntary provision of data
  • Provision of personal data is voluntary, however failure to provide data may result in the lack of employment opportunities through our company.
9. Data Sharing
  • We do not share your personal information with third parties, except when necessary for the recruitment process (for example, to provide information to potential employers with your consent).
10. Automated Decision Making
  • Your personal data will not be used for automated decision making.
  • All decisions related to participation in the recruitment process are made solely on the basis of the participation of the company’s manager and the employer’s representative, based on an individual consideration of each candidate.

1. Purpose
  • These rules define the procedure for processing, storing, protecting and accessing personal data in Jobs Hire Sp. z o.o. in accordance with the requirements of European legislation.

  • 6.1. Personal data may be transferred: to potential employers and contractors only with the prior consent of the client.
  • 6.2. In exceptional cases, data may be provided to government agencies in accordance with the law.
7. Technical and organizational measures to protect personal data
  • 7.1. Computer protection: using special passwords.
  • 7.2. Access control: to customer databases.
  • 7.3. Protection of paper documents: in accessible areas (cabinets, safes) only for authorized persons.
  • 7.4. Backup: data.
  • 7.5. Use of antivirus software.
8. Storage period of personal data
  • 8.1. Customer data: stored for up to 3 years or until consent to the processing of personal data is revoked.
  • 8.2. Employee data: for a period of up to 10 years.
  • 8.3. Partner data: until the termination of cooperation under concluded business agreements.
9. Rights of individuals whose personal data is processed
  • 9.1. Access to your data: correcting it, transferring data, filing complaints with the relevant authorities.
10. Response to data leaks
  • 10.1. In the event of a data leak:
    • 10.2. Immediately notify: the responsible person.
    • 10.3. Conduct an investigation: of the incident.
    • 10.4. Record: and document the incident.
11. Final Provisions
  • 11.1. These rules: shall enter into force on the date of approval.
  • 11.2. All persons having access: to personal data are required to comply with these rules.
  • 11.3. The document is reviewed: once a year, and changes are made to it as necessary.
